Policy<\/h2>\n\n\n\n<p>Issued: July 1, 2015<strong>\u00a0<br><\/strong>Last Revised: March 6, 2024<strong>\u00a0<br><\/strong>Last Reviewed: July 15, 2024<strong>\u00a0<\/strong><\/p>\n\n\n\n<p><strong>\u200b\u200bApplies to:\u200b <\/strong><em>Faculty (including part-time and visiting faculty), postdoctoral scholars, staff and students (including graduate\/undergraduate student workers and graduate assistants or students in clinical program seeking licensure) employed by the University of Southern California, USC Health System, and their respective subsidiaries and affiliates in addition to volunteers (\u201cUSC employees\u201d).\u00a0 This policy continues to apply to individuals on sabbatical, other leaves or while visiting other institutions.<\/em>\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Policy Purpose<\/h2>\n\n\n\n<p>Mandated Reporters have an individual duty to report known or suspected abuse or neglect relating to children, elders, or dependent adults. Any employees whose positions are designated by the state of California as Mandated Reporters must understand what they are required to report, when it must be reported, and to whom. Summary information regarding the three categories of mandated reports is provided below.<strong><\/strong><\/p>\n\n\n\n<p>The <a href=\"https:\/\/policy.usc.edu\/protecting-minors\/\">Protecting Minors Policy<\/a> is a companion policy that details Mandated Reporters responsibilities specific to known or suspected abuse or neglect of minors as well as the management of university activities involving minors.&nbsp; Although Mandated Reporter obligations for reporting suspected child abuse and neglect are referenced in this policy, this policy does not supersede or alter any requirements set forth in the Protecting Minors Policy, which governs all Mandated Reporter requirements for reporting known or suspected child abuse and neglect.<strong><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Scope and Application<\/h2>\n\n\n\n<p><strong>\u200b<\/strong><strong>\u200b<\/strong>California law designates University of Southern California (\u201cUSC\u201d) employees holding certain positions as \u201cMandated Reporters\u201d (defined below and in\u202f<a href=\"https:\/\/policy.usc.edu\/wp-content\/uploads\/2021\/07\/Appendix-A-California-abuse_neglect-mandated-reporters-1-2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Appendix A<\/a>). Mandated Reporters have an individual duty to report known or suspected abuse or neglect relating to children, elders or dependent adults. USC employees whose positions are designated by the state as Mandated Reporters, or by USC policy, must understand what they are required to report, when it must be reported, and to whom. Summary information regarding the three categories of mandated reports is provided below.&nbsp;<\/p>\n\n\n\n<p>\u200bSome schools and departments may offer additional guidance related to abuse reporting. Those procedures are in addition to, but do not replace, the procedures described in this policy. USC employees should refer to their department or facility for those additional abuse reporting procedures.\u200b<strong><\/strong>&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Definitions<\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Term\u00a0<\/strong><\/td><td><strong>Definition\u00a0<\/strong><\/td><\/tr><tr><td>Mandated Reporter&nbsp;<\/td><td>Employee who is required by law to report a particular category or type of abuse to the appropriate law enforcement or social service agency.&nbsp;<\/td><\/tr><tr><td>Child&nbsp;<\/td><td>Person under age 18. (Penal Code \u00a7 11165)&nbsp;<\/td><\/tr><tr><td>Elder&nbsp;<\/td><td>Person age 65 or older. (Welfare &amp; Inst. Code \u00a7 15610.26)&nbsp;<\/td><\/tr><tr><td>Dependent Adult&nbsp;<\/td><td>Person between ages 18 and 64 with a physical or mental limitation that restricts his or her ability to carry out normal activities or protect his or her rights. Includes all people between ages 18 and 64 who have been admitted as an inpatient to a 24-hour health care facility. (Welfare &amp; Inst. Code \u00a7 15610.23)&nbsp;<\/td><\/tr><tr><td><strong><\/strong><strong>Employee<\/strong>&nbsp;<\/td><td>University employees, including University staff employees and non-University employees (such as employees of a staffing agency providing temporary personnel to the University) as defined in USC\u2019s\u202f<a href=\"https:\/\/policy.usc.edu\/employee-definition\/\" target=\"_blank\" rel=\"noreferrer noopener\">Employee Definitions policy<\/a>.&nbsp;<\/td><\/tr><tr><td><strong><\/strong><strong>Covered Activity<\/strong>&nbsp;<\/td><td>Any activity, camp, program and\/or event in which the care, custody, and\/or supervision of one or more Minors (other than Minors who are Employees or Students) is reasonably expected to be the responsibility of one or more Covered Activity Staff, including University Employees, Students, Volunteers, and\/or Third-Party staff acting on behalf of or pursuant to a contract with the University.&nbsp;<\/td><\/tr><tr><td><strong><\/strong><strong>Covered Activity Staff<\/strong>&nbsp;<\/td><td>All individuals reasonably expected to work with or otherwise come into Direct Contact with Minors in a Covered Activity. This includes Employees, Students, Volunteers, and Third Parties administering a Covered Activity, including all individuals employed by, contracted by, or volunteering for a Third Party in connection with a Covered Activity.&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">5. Policy Details<\/h2>\n\n\n\n<p><strong>\u200b<\/strong><strong>\u200b<\/strong><strong>Child Abuse\/Neglect<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bThe state of California has established various laws that seek to protect children from all forms of abuse, including the Child Abuse and Neglect Reporting Act (\u201cCANRA\u201d) set forth in\u202f<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=PEN&amp;division=&amp;title=1.&amp;part=4.&amp;chapter=2.&amp;article=2.5\" target=\"_blank\" rel=\"noreferrer noopener\">California Penal Code \u00a7\u00a7 11164-11174.3<\/a>.\u202fCANRA imposes mandatory reporting obligations upon certain categories of employees, referred to as \u201cMandated Reporters\u201d (for a full and specific list of categories defined by CANRA see California Penal Code <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=11165.7.\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a711165.7<\/a>).<strong> However, USC seeks to promote the protection of minors more broadly by requiring that all University Employees and Covered Activity Staff, regardless of whether they qualify as Mandated Reporters under CANRA, immediately report suspected Child Abuse and Neglect, as well as all other serious incidents or violations relating to minors, to the appropriate external agencies and University officials as described in the <\/strong><a href=\"https:\/\/policy.usc.edu\/protecting-minors\/\" target=\"_blank\" rel=\"noreferrer noopener\">Protecting Minors Policy<\/a> (see Section 6.I. Reporting Requirements for more information, including who must report and the reporting process).&nbsp; &nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Dependent Adult\/Elder Abuse<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Who must report (Welfare &amp; Inst. Code \u00a7 15630)<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bThe following categories of employees are Mandated Reporters for elder or dependent adult abuse:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bAny employee (including support staff and maintenance staff) working in any facility that provides any elder or dependent care services\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bAny employee providing direct health care or social services to an elder or dependent adult\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bHealth care practitioners\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bClergy\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>\u200b<\/strong><strong>What must be reported (Welfare &amp; Inst. Code \u00a7 15630(b))<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bThe following general categories of incidents of abuse of an elder or dependent adult must be reported when a Mandated Reporter has observed, has knowledge of or reasonably suspects the abuse, or is told by the elder or dependent adult that such abuse has occurred:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bPhysical abuse\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bAbandonment\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bAbduction\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bIsolation\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bFinancial abuse\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200bNeglect\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>\u200b<\/strong><strong>Injury by Firearm or Assault\/Abuse<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Who must report (Penal Code \u00a7 11160(a))<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bAll healthcare practitioners, if in their professional capacity or within the scope of their employment provide medical services for a <em>physical<\/em> condition to a patient whom the health practitioner knows or reasonably suspects resulted from injury by firearm or assault\/abuse must report to law enforcement. &nbsp;<\/p>\n\n\n\n<p>\u200bAny health practitioner providing services in a health facility, clinic or physician\u2019s office who knows or reasonably suspects that a patient to whom the practitioner is providing services is the victim of assaultive or abusive conduct or a firearm injury.&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>What must be reported (Penal Code \u00a7 11160(a)(1),(2),(d))<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bHealthcare practitioners must report <em>physical<\/em> injuries the healthcare practitioner knows or reasonably suspects is caused by a firearm or the result of assaultive or abusive conduct \u2014whether inflicted by the patient or another; murder; manslaughter; mayhem; aggravated mayhem; torture; or assault with intent to commit mayhem, rape, sodomy, or oral copulation; assault with a stun gun, taser, deadly weapon, firearm, assault weapon, or machine likely to produce great bodily injury; administration of a controlled substance or anesthetic to aid in commission of a felony; battery; sexual battery; incest; rape; spousal rape; procuring a female to have sex with another man; sodomy; oral copulation; sexual penetration; lewd and lascivious acts with a child; throwing chemical substances with the intent to injure or disfigure; elder abuse; abuse of spouse, cohabitant, or an elder; or an attempt to commit any of these crimes.&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Enforcement<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bFor those who are mandated reporters under California law, failure to report is a misdemeanor punishable by up to six months in jail or a fine of up to $1000, or both (Penal Code \u00a7\u00a7 11162, 11166(c); Welfare &amp; Inst. Code \u00a7 15630(h)). In some cases, failure to report elder or dependent adult abuse may result in up to one year in jail or a fine of up to $5000, or both (Welfare &amp; Inst. Code \u00a7 15630(h)).&nbsp;<\/p>\n\n\n\n<p>\u200bFailure to report is serious neglect of duty that can lead to progressive discipline for both faculty and staff, including termination.&nbsp;<\/p>\n\n\n\n<p>\u200bAll employees who are Mandated Reporters under California law are required to sign the relevant acknowledgment forms (see Forms, below).<strong>\u200b<\/strong>&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Procedures<\/h2>\n\n\n\n<p><strong>\u200b<\/strong><strong>\u200b<\/strong><strong>Child Abuse\/Neglect<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Reporting process (Penal Code \u00a7 11166)<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bSuspected Child Abuse and Neglect, as well as all other serious incidents or violations relating to minors, <strong>must be immediately reported to the appropriate external agencies and University officials as described in the <\/strong><a href=\"https:\/\/policy.usc.edu\/protecting-minors\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Protecting Minors Policy<\/strong><\/a><strong> (see Section 6.I. Reporting Requirements).<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Dependent Adult\/Elder Abuse<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Reporting procedures (Welfare &amp; Inst. Code \u00a7 15630(c))<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<p>\u200bThe appropriate reporting agency for elder and dependent adult abuse depends on the location in which the abuse occurred, not the location in which it was discovered. After a report has been made using the procedures below, follow up and status updates may be obtained via the Adult Protective Services Mandated Reporter Hotline at (888) 202-4248.&nbsp;<\/p>\n\n\n\n<p><strong>\u200b<\/strong><strong>Long-term care or adult day health care center<\/strong><strong><\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u200b<\/strong><strong>Immediately<\/strong>\u2014Telephone report to the Long Term Care Ombudsman Program at (800) 334-9473 Monday \u2013 Friday, 8:30 a. \u2013 5:00 p.m. or (800) 231-4024, After Hours.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u200b<\/strong><strong>Within two working days<\/strong>\u2014Written report via online reporting portal at <a href=\"https:\/\/hsslacountyprod.wellsky.com\/assessments\/?WebIntake=A6DCB64F-7D31-4B6D-88D6-0A8FA7EA505F\" target=\"_blank\" rel=\"noreferrer noopener\">Adult Protective Services Web Intake<\/a> or on Form SOC341 \u201cReport of Suspected Dependent Adult\/Elder Abuse\u201d to Long Term Care Ombudsman; address to be provided when making telephone report.
